1. Acceptance of Terms

By downloading, installing, or using the Vitality app ("App"), you agree to these Terms of Use ("Terms"). If you do not agree, do not use the App. These Terms form a legally binding agreement between you and Rushing Technologies LLC.

2. Description of Service

Vitality is a personal wellness tracking app that lets you monitor fitness, sleep, nutrition, mental health, and daily habits. It includes an AI-powered coaching feature that provides personalized insights and motivational guidance.

3. AI Coach — Disclaimer & Limitations

The AI Coach feature uses large language model technology (powered by Anthropic's Claude) to generate responses based on your health data and questions.

You acknowledge and agree that:

• AI-generated responses are for informational and motivational purposes only.
• The AI Coach is not a licensed medical professional, dietitian, therapist, or any other healthcare provider.
• AI responses may be inaccurate, incomplete, or not appropriate for your individual situation.
• You should never disregard professional medical advice or delay seeking it because of something the AI Coach said.
• Rushing Technologies LLC is not liable for any decisions you make based on AI Coach outputs, including health, fitness, dietary, or lifestyle decisions.
• In a medical emergency, call 911 or your local emergency services — do not rely on the app.

4. Eligibility

You must be at least 13 years old to use the App. By using the App, you represent that you meet this requirement. If you are under 18, you represent that a parent or guardian has consented to these Terms.

5. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You are responsible for all activity under your account.
• Notify us immediately at [email protected] if you suspect unauthorized access.

6. Subscription & Payments

Vitality Premium is offered as an auto-renewing subscription processed entirely through the Apple App Store. By subscribing, you agree to Apple's payment terms in addition to these Terms.

• Free trial: New subscribers receive a 7-day free trial. Your trial begins when you confirm the subscription with your Apple ID. You will not be charged during the trial period.
• Auto-renewal: At the end of the free trial, your subscription automatically renews at the then-current price (currently $19.99/month) and continues to auto-renew monthly unless cancelled. Payment is charged to your Apple ID at confirmation of purchase and at the start of each renewal period.
• Cancellation: You may cancel at any time by going to Settings → [Your Name] → Subscriptions → Vitality on your iOS device. Cancellation takes effect at the end of the current billing period; you retain access to Premium features until then.
• No charges during trial: To avoid being charged, cancel at least 24 hours before the trial ends.
• Price changes: We will notify you in advance of any price changes. Continued use after a price change takes effect constitutes acceptance of the new price.
• Refunds: All refund requests are handled by Apple. Visit reportaproblem.apple.com to request a refund.

7. Acceptable Use

You agree not to:

• Use the App for any unlawful purpose
• Attempt to reverse-engineer, decompile, or hack the App
• Upload false, misleading, or harmful health data
• Use the App to harm yourself or others
• Resell or sublicense access to the App

8. Health Data & Apple HealthKit

You grant Vitality permission to read health data from Apple HealthKit solely to power your in-app experience. You are responsible for the accuracy of manually entered health data. Vitality does not guarantee the accuracy of data imported from third-party devices or services.

9. Intellectual Property

All content, design, and software in the App is owned by Rushing Technologies LLC or licensed to us. You may not copy, modify, or distribute any part of the App without our written permission.

10. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. RUSHING TECHNOLOGIES LLC DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE OR UNINTERRUPTED.

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RUSHING TECHNOLOGIES LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP OR RELIANCE ON AI-GENERATED CONTENT. OUR TOTAL LIABILITY TO YOU SHALL NOT EXCEED THE AMOUNT YOU PAID IN THE 12 MONTHS PRECEDING THE CLAIM.

12. Termination

We may suspend or terminate your account if you violate these Terms. You may delete your account at any time from the app's Settings screen.

13. Governing Law

These Terms are governed by the laws of the State of Texas, USA, without regard to conflict of law principles.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or email. Continued use after changes constitutes acceptance of the updated Terms.
